Olympic Fly Fishers of Edmonds (OFF)

This Youth / Minor Hold Harmless Agreement applies only when a minor participates in activities, events, outings, meetings, programs, clinics, trips, or other functions promoted, organized, sponsored, or facilitated by Olympic Fly Fishers of Edmonds (“OFF”).
 

For purposes of this Agreement, a “minor” is defined as any individual under the age of eighteen (18).

 

In consideration of the right granted for my minor child or legal ward (“the minor”) to participate in OFF activities, I, as the parent or legal guardian, acknowledge that the minor’s participation is voluntary and undertaken entirely at my own initiative, risk, and responsibility on behalf of the minor.

 

I, by joining or renewing my membership in Olympic Fly Fishers of Edmonds and/or by bringing a minor to participate in OFF activities, for myself and on behalf of the minor, and for our respective heirs, executors, and administrators, do hereby remise, release, hold harmless, and forever discharge Olympic Fly Fishers of Edmonds, including its officers, board members, volunteers, event leaders, and representatives, acting officially or otherwise, from any and all claims, demands, actions, or causes of action arising out of or related to the minor’s participation in OFF activities.

 

This release and waiver is made on behalf of the minor and expressly includes claims arising from the ordinary negligence of Olympic Fly Fishers of Edmonds, its officers, board members, volunteers, event leaders, and representatives, to the fullest extent permitted by Washington state law.

 

This includes, but is not limited to, claims arising from injury, illness (including but not limited to COVID-19 or other communicable diseases), death, or loss of or damage to personal property, from any cause whatsoever, while the minor is participating in OFF activities.

 

I fully understand and acknowledge the inherent risks and dangers involved in fly fishing and related outdoor and travel activities, including but not limited to wading in rivers, lakes, and streams; boating; uneven or slippery terrain; changing weather and water conditions; encounters with wildlife; use of sharp hooks and equipment; and travel to and from activity locations. I knowingly and voluntarily assume all such risks on behalf of the minor, whether known or unknown.

 

Supervision and Responsibility for Minors

 

I acknowledge and agree that minors are not permitted to participate in Olympic Fly Fishers of Edmonds activities without the presence of a parent or legal guardian. I further acknowledge that I am solely responsible for the supervision, safety, conduct, and well-being of the minor at all times while the minor is participating in OFF activities.

 

I understand and agree that Olympic Fly Fishers of Edmonds does not provide supervision, childcare, or guardian services, and that OFF officers, volunteers, and event leaders are not responsible for supervising minors.

 

I further acknowledge and agree that I and the minor will comply with all applicable directions, instructions, rules, and safety guidance provided by OFF officers, volunteers, or event leaders.

 

I agree to indemnify, defend, and hold harmless Olympic Fly Fishers of Edmonds, its officers, board members, volunteers, event leaders, and representatives from and against any claims, demands, damages, losses, costs, or expenses (including reasonable attorneys’ fees) arising out of or related to the minor’s participation in OFF activities or my breach of this Agreement.

 

In the event of injury or illness to the minor while participating in OFF activities, I hereby authorize Olympic Fly Fishers of Edmonds, its officers, members, volunteers, and agents to seek appropriate medical attention for the minor, as deemed necessary.

 

I affirm that I have read this Agreement in its entirety, fully understand the release and assumption of risk I am providing on behalf of the minor, and agree to be bound by its terms. I further attest that I am the parent or legal guardian of the minor participant and am legally authorized to consent to this Agreement on the minor’s behalf.
